AI and Competition: How the EU AI Act will shape dynamics and enforcement

With the proliferation of AI, the effects of the technology on competition is increasingly coming under scrutiny, where the issue of how to prevent or reduce the potential negative impact of AI on market competition is beginning to influence policy discussions. The EU already has a comprehensive and well-established legal framework and enforcement practices concerning competition, and, thus far, concerns regarding competition arising from AI technologies have been addressed within this existing legal framework and enforcement practices.

Despite its few references to competition and its legal framework, the AI Act, with its broad framework for the safe and reliable development and use of AI technologies, has the potential to support the competitive environment in the markets and competition law practices. In this blog post, we will examine how the AI Act could interact with EU competition law and its enforcement.
