Colorado’s Senate Bill 169 was introduced in March 2021 and passed in June of 2021 before being signed into law in July 2021 to prohibit unfair discrimination in insurance practices. In particular, the law targets external customer information sources, algorithms, and predictive models, prohibiting discrimination based on race, color, national or ethnic origin, religion, sex, sexual orientation, disability, gender identity, or gender expression.
Given the wide scope of the law, which was due to be effective from 1 January 2023 at the earliest, Colorado’s Commissioner of Insurance has been tasked with developing specific requirements for different types of insurance and insurance practices through a stakeholder consultation process, with the majority of the activity so far concentrating on underwriting in automotive insurance and health and life insurance.
