
Does NYC Local Law 144 apply to agentic AI HR systems?

New York City Local Law 144 requires annual independent, impartial bias audits of automated employment decision tools (AEDT). Since its enforcement starting on 5 July 2023, AI has evolved rapidly. This is particularly true in the case of generative AI, with employers and vendors of HR tools increasingly capitalising on the transformative potential of large language models (LLMs) and agentic AI systems.
Despite the widespread use of these technologies largely occurring after the passing and enforcement of Local Law 144, that’s not to say that Local Law 144 does not apply to LLMs and technologies powered by them, such as AI agents. Indeed, depending on how they are used, AI agents can very much be in the scope of Local Law 144.
